INDEMNIZACIÓN GLOBAL EN SUSTITUCIÓN DE UNA INCAPACIDAD PARCIAL PERMANENTE DERIVADA DE UN RIESGO DE TRABAJO VALUADA HASTA EN UN VEINTICINCO POR CIENTO. EL INSTITUTO MEXICANO DEL SEGURO SOCIAL DEBE OTORGARLA CON LOS INCREMENTOS AL SALARIO BASE, SIN PERJUICIO DE QUE SE PAGUE EN UNA SOLA EXHIBICIÓN Y NO EN FORMA PERIÓDICA.
De la interpretación armónica de los artículos 123, apartado A, fracciones XIV y XXIX, de la Constitución Política de los Estados Unidos Mexicanos, y 48 a 50 y 65 de la Ley del Seguro Social derogada, se concluye que cuando un trabajador asegurado sufra un riesgo de trabajo que le produzca una incapacidad parcial permanente valuada hasta en un veinticinco por ciento, tendrá derecho a que el Instituto Mexicano del Seguro Social le otorgue, como prestación en dinero, una indemnización global equivalente a cinco anualidades de la pensión que le hubiese correspondido, sin perjuicio de que esta última se pague con los incrementos al salario base en una sola exhibición y no en forma periódica, como acontece con las pensiones, dado que tal circunstancia no implica que se extinga el vínculo existente entre el aludido instituto y el asegurado, pues el mismo no nace de la voluntad de las partes, sino del aseguramiento obligatorio previsto en el numeral 12 de la citada ley.
