ACTO RECLAMADO NEGATIVO. LA AUTORIDAD RESPONSABLE DEBE COMPROBAR QUE CUMPLIO LOS REQUISITOS QUE SE LE RECLAMAN.
Advirtiéndose que los actos reclamados consisten en omisiones o hechos negativos de las autoridades responsables, debe entenderse que la carga de la prueba de esas omisiones o de los hechos negativos, no corresponde a la parte quejosa, sino que es a las responsables a las que toca demostrar que no incurrieron en ellos.
