Artículo 175

Artículo 175. Las medidas cautelares podrán decretarse:
I. Durante el juicio, y
II. Antes de iniciarse el juicio.
En el primer caso, se substanciará vía incidental y conocerá de éste el Juez que, al ser presentada la solicitud de la medida cautelar, esté conociendo del asunto.
En tratándose del segundo supuesto, se tramitará a petición directa por el Ministerio Público y se notificará la medida cautelar a la Persona Afectada inmediatamente después de ejecutada ésta.
