REINCIDENCIA. LAS COPIAS AUTORIZADAS DE LAS SENTENCIAS, ASI COMO LA DE LOS AUTOS QUE LAS DECLARAN EJECUTORIADAS SON LOS UNICOS MEDIOS PARA ACREDITAR LA.
El medio eficaz para acreditar la reincidencia del acusado lo constituyen las copias autorizadas de las sentencias anteriores, así como la de los autos que las declararon ejecutoriadas, por ser los únicos testimonios apropiados para dilucidar si en el asunto sometido a juicio se cumplieron con las exigencias que hacen operante la figura jurídica en comento; por tanto, si el órgano técnico de acusación no aportó tales elementos de convicción, es evidente que la resolución pronunciada en ese sentido es conculcatoria de garantías.
