APELACIONES PENDIENTES QUE QUEDAN SIN MATERIA, CUANDO SE CONSIENTE LA SENTENCIA DEFINITIVA.
Admitir la sentencia definitiva o consentirla implícitamente por no expresar agravios en tiempo, también significa admitir todas las violaciones procesales que se hubieran cometido durante el procedimiento; esto es, cuando ocurre una situación como ésta, automáticamente quedan sin materia las apelaciones, que siendo primeras en tiempo y que debieron resolverse antes que la apelación contra la sentencia definitiva, ya no tiene caso resolverlas, por haberse consentido la sentencia definitiva por el mismo litigante que había interpuesto aquélla.
