REINCIDENCIA. SU ACREDITACIÓN PUEDE REALIZARSE CON LAS COPIAS AUTORIZADAS DE SENTENCIAS CONDENATORIAS ANTERIORES, ASÍ COMO DE LOS AUTOS QUE LAS DECLARAN EJECUTORIADAS, O POR OTROS ELEMENTOS DE PRUEBA, QUE VALORADOS EN SU CONJUNTO LA ACREDITEN DE MANERA INDUBITABLE.
La reincidencia, para efectos de la individualización de la pena o cualquier otro que resulte en el procedimiento, puede acreditarse con las copias autorizadas de las sentencias condenatorias anteriores, así como con los autos que las declararon ejecutoriadas, por ser las pruebas idóneas o eficaces para llegar a dicha determinación; sin embargo, ello no resulta un obstáculo para que mediante otros elementos de prueba, que valorados en su conjunto, puedan llevar a la convicción de que quedó acreditado de manera indubitable dicho extremo.
