PRUEBA CONFESIONAL EN MATERIA LABORAL. POSICIONES FORMULADAS EN SENTIDO NEGATIVO, SON INSIDIOSAS.
Las posiciones formuladas negativamente en una prueba confesional en materia laboral, pueden generar estado de confusión en el absolvente, dado que de conformidad con el artículo 790, fracción VI, de la Ley Federal del Trabajo, deben ser contestadas afirmando o negando, y por tanto, la respuesta de un "sí", puede ser emitida con la intención de negar lo que se afirma en la posición y no con la idea de admitir su contenido, y viceversa, al responder con un "no", pudiera pretender confirmar lo que dice y no por el contrario desmentirla, traduciéndose así en posiciones insidiosas.
