ACCION REIVINDICATORIA. LITISCONSORCIO PASIVO NECESARIO NO OPERA CONTRA ANTERIORES PROPIETARIOS DEL INMUEBLE EN LITIGIO (LEGISLACION DEL ESTADO DE CHIAPAS).
El litisconsorcio surge en las acciones constitutivas, pero tratándose del ejercicio de la acción reivindicatoria, no opera el litisconsorcio en contra de los anteriores propietarios del inmueble materia de la litis, por ser una acción real y de condena y se da cuando se actualizan los supuestos a que se refieren los artículos del 4 al 7 del Código de Procedimientos Civiles del Estado de Chiapas, en contra de quien detenta la posesión y se ejerce por quien es propietario del bien que se pretende reivindicar.
