RIESGO PROFESIONAL, INDEMNIZACION POR. LA CONVENIDA EN LOS CONTRATOS COLECTIVOS SUPERIOR A LA QUE TIENE OBLIGACION DE PAGAR EL SEGURO SOCIAL, DEBE CUBRIRLO LA EMPRESA.
Cuando las prestaciones contractuales por muerte de un trabajador afiliado al seguro social, derivada de un riesgo profesional, son superiores a las que concede la Ley Federal del Trabajo por ese mismo concepto, surge una doble obligación: la primera a cargo del Instituto Mexicano del Seguro Social, que absorbe las obligaciones establecidas en la ley laboral de acuerdo con lo dispuesto por el artículo 46 de la Ley del Seguro Social, y la segunda a cargo del patrón, que se traduce en el pago de la diferencia que resulte de comparar el monto de la prestación contractual con el de la legal.
