No reclamada la resolución presidencial en sí misma, sino la indebida ejecución de la propia resolución, para disponer de la acción constitucional de amparo el quejoso no tiene por qué demostrar que su propiedad se encontraba amparada con certificado de inafectabilidad, ni tampoco que comprobar que satisfacía los requisitos de los artículos 66 del Código Agrario anterior y 252 de la nueva Ley Federal de Reforma Agraria, no procediendo sobreseer el juicio con base en los artículos 27, fracción XIV de la Constitución General de la República, 73, fracciones XII y XVIII, 74, fracción III, de la Ley de Amparo, 103, 104, 196, 203 al 207 y 252 de la Ley Federal de Reforma Agraria.
