AUTORIZADO PARA OIR NOTIFICACIONES EN EL AMPARO. CARECE DE LEGITIMACION PARA DESISTIR DE LAS PRUEBAS QUE HUBIESE OFRECIDO.
Conforme a lo dispuesto por el artículo 27 de la Ley de Amparo, la persona autorizada para oír notificaciones en los juicios de garantías únicamente está facultada para promover o interponer los recursos que procedan, ofrecer y rendir pruebas y alegar en las audiencias, pero no para desistir, en perjuicio de sus autorizantes, de las pruebas que hubiese ofrecido y que le hubieran sido admitidas por el Juez de Distrito correspondiente. Por tanto, no es legalmente correcto que dicho juzgador tenga por desistido al aludido autorizado de las pruebas ofrecidas por éste y, de hacerlo, viola las reglas fundamentales que norman el procedimiento del juicio constitucional.
