SEGURO SOCIAL, DELEGACIONES REGIONALES Y ESTATALES DEL INSTITUTO MEXICANO DEL. SON INCOMPETENTES PARA ORDENAR VISITAS DE AUDITORIA A LAS EMPRESAS.
De conformidad con el artículo 11 del Reglamento de Delegaciones Regionales y Estatales del Instituto Mexicano del Seguro Social, publicado en el Diario Oficial de la Federación el 26 de julio de 1967, los delegados regionales y estatales sólo tienen facultades para solicitar a las autoridades superiores del instituto que ordenen auditorías a las empresas remisas, pero no deben hacerlo por sí mismos, ya que las autoridades administrativas sólo pueden realizar aquellos actos que expresamente les concedan las leyes. Así pues, cualquier orden de auditoría a empresas emitidas por un delegado regional o estatal del Instituto Mexicano del Seguro Social será contraria al artículo 16 de la Constitución, por provenir de autoridad incompetente.
