INTERESES MORATORIOS, ARTICULO 362 DEL CODIGO DE COMERCIO.
Aun cuando el numeral 362 del Código de Comercio, establece la posibilidad de fijar hasta el 6% anual de intereses moratorios, ello sólo es aplicable para el supuesto de que las partes no hubieran expresamente convenido el porcentaje o cuando éste fuere tan desproporcionado, que permitiera advertir un abuso, aprovechándose del apuro económico y de la inexperiencia o ignorancia del deudor; en cuyas condiciones, a petición de éste, el Juez podrá reducirlo equitativamente, en términos del artículo 17 del Código Civil del Estado de México.
