RIESGO DE TRABAJO, INDEMNIZACION POR. CORRESPONDE SU PAGO AL INSTITUTO MEXICANO DEL SEGURO SOCIAL EN CASO DE SUBROGACION, AUN CUANDO SU PAGO SE RECLAME AL PATRON.
Cuando en un contrato colectivo de trabajo se estipulan indemnizaciones por riesgo de trabajo iguales a las establecidas en la Ley Federal del Trabajo, y el actor reclama su pago al patrón, es suficiente que se pruebe haberlo asegurado ante el Instituto Mexicano del Seguro Social, para que llamado a juicio éste, se subrogue en el cumplimiento de las obligaciones del patrón respecto a tales responsabilidades de conformidad con el artículo 60 de la Ley del Seguro Social.
